Terms of Use

Effective date: 14 October 2026

Welcome to the AVA Music Awards website and platform. These Terms of Use explain the conditions for accessing and using AVA’s website, user accounts, artist profiles, work submissions and related services.

By accessing or using the platform, you agree to these Terms. If you do not agree, please do not use services that require acceptance of them.

1. About AVA

The AVA Music Awards are an international awards platform created to recognize the artistic achievements of Iranian artists and music professionals around the world.

The website provides information about AVA, supports artist registration and work submissions, and facilitates participation in the AVA community and Academy, subject to the applicable rules and requirements.

These Terms govern the use of the website and platform. Participation in the Awards, artist eligibility, submissions, Academy membership and voting are also subject to the applicable AVA Music Awards Rules and Regulations and any additional requirements published for the relevant award cycle.

2. Eligibility and User Accounts

Certain platform features require a user account.

When creating or using an account, you agree to:

  • Provide accurate information and keep it reasonably up to date.

  • Use your account for lawful purposes and in accordance with these Terms.

  • Take reasonable steps to protect your login credentials.

  • Notify AVA if you become aware of unauthorized access to your account.

  • Not impersonate another person or misrepresent your professional identity, authority or affiliation.

You are responsible for activity carried out through your account, except where applicable law provides otherwise or the activity results from circumstances for which you are not responsible.

Account registration does not automatically grant artist approval, Academy Membership, voting rights or acceptance of any submitted work. These are separate processes governed by AVA’s applicable requirements.

3. Artist Profiles and Registration

Artist profiles may be created by the artist but can then be managed by them or a person authorized to represent the artist.

By registering an artist profile, you confirm that:

  • You are the artist or have the authority the group/band to act on the whole group’s behalf.

  • The information you provide is accurate to the best of your knowledge.

  • You will provide reasonable clarification or supporting information if AVA requests it.

  • You understand that submitted profile information may form part of AVA’s official artist registry.

Artist profiles may be reviewed and assigned a status, including Under Review, Approved or Rejected. Registration does not guarantee approval.

Artist profile approval and work submission approval are separate processes. A pending artist profile does not, by itself, mean that a work cannot be submitted.

Changes to artist identity information may require review and approval by AVA in accordance with the applicable procedures.

4. Work Submissions

Works may be submitted through the official AVA platform in accordance with the relevant submission procedures and award-cycle requirements.

By submitting a work, you confirm that:

  • The information provided is accurate to the best of your knowledge.

  • You are the rights holder or have the necessary authority and permissions to submit the work and associated material for consideration.

  • The material does not knowingly infringe another person’s rights.

  • You will respond reasonably to requests for clarification or supporting information.

  • Should a work get nominated or become winner of one or more categories, that doesn’t necessarily grant the member who registered it, the credit.

AVA may review submissions for eligibility, completeness, minimum production quality, category placement and compliance with the applicable Awards Rules and Regulations.

Submission does not guarantee acceptance, nomination or selection as a winner. AVA may reject or exclude a submission that is incomplete, materially inaccurate, unauthorized, ineligible or otherwise inconsistent with the applicable requirements.

5. Submission Licence and Rights Authorization

5.1. Licence Granted to AVA

By submitting a work or any related material to the AVA Music Awards (“AVA”), the submitting party grants AVA a worldwide, perpetual, irrevocable, royalty-free, transferable and sublicensable, non-exclusive licence to access, collect, reproduce, archive, store, preserve, adapt, arrange, edit, modify, create derivative works from, perform, display, publish, distribute, communicate, transmit, broadcast and otherwise use the submitted material, in whole or in part, in any format or medium, whether currently existing or developed in the future, for purposes determined by AVA in connection with its activities, operations, Awards, events, communications, promotion, documentation and related projects.

5.2. Permitted Uses

The licence includes, without limitation, the right to:

  • Receive, store, archive, preserve and reproduce submitted works and related materials for the administration and documentation of AVA and its Awards.

  • Make submitted works and materials available to authorized AVA Academy Members, reviewers, evaluators and other relevant participants for assessment, consideration and voting.

  • Publish or display submitted works, excerpts, titles, artwork, photographs, biographies and related information in connection with AVA, its nominees, finalists, winners and Awards.

  • Use all or part of submitted material in promotional content, trailers, teasers, compilations, interviews, documentaries, audiovisual productions, social media posts, online publications, websites, video platforms, YouTube content, press materials and other communications relating to AVA or its activities.

  • Incorporate submitted music into audiovisual productions, background music, event presentations, promotional videos and other content produced, commissioned, distributed or authorized by AVA.

  • Arrange, adapt, edit, modify, reproduce or otherwise transform submitted works, including arranging or re-performing a submitted musical work through an AVA house band or other performers, commissioning new recordings or versions, and incorporating such performances into AVA events, recordings, promotional materials or broadcasts.

  • Record, reproduce, distribute, transmit, stream, communicate and broadcast submitted material or performances based on it, in whole or in part, through television, online platforms, social media, live streams, recorded broadcasts and other current or future distribution channels, worldwide.

  • Authorize production companies, broadcasters, streaming services, distributors, promotional partners, service providers and other parties working with AVA to exercise the rights granted under this licence to the extent necessary for the relevant activities.

AVA may determine the format, duration, presentation, editing, placement and manner of such uses, subject to applicable law and the scope of the rights validly granted to AVA.

5.3. Ownership and Attribution

The submission of a work does not, by itself, transfer ownership of the underlying copyright or other intellectual property rights to AVA. Such ownership remains with the respective rights holders, subject to the licence granted under this section.

AVA will make reasonable efforts to identify and credit the principal creators of submitted works on the relevant AVA platform or in accompanying materials, as appropriate to the nature, format and circumstances of the use. The submitting party acknowledges that credit may not be practicable in every instance, including certain broadcast, background-music, short-form or technical uses.

Attribution does not limit the rights granted to AVA under this licence.

5.4. Rights, Authority and Permissions

By submitting a work, the submitting party represents and warrants that they own, control or are duly authorized to grant the rights specified in this section and that the submission and the exercise of those rights by AVA, within the scope of this licence, do not knowingly infringe the rights of any third party.

The submitting party is responsible for obtaining all permissions, consents and authorizations necessary for the rights they grant, including, where applicable, rights held by co-creators, composers, lyricists, publishers, record labels, master recording owners, performers and other relevant rights holders.

Where the submitting party does not control all rights necessary for a proposed use, they must disclose the relevant restrictions to AVA and cooperate in obtaining any additional permissions required. AVA may request supporting documentation, restrict a particular use, or decline to use the relevant material for a particular purpose if the necessary rights cannot be established or secured.

Nothing in this section purports to grant AVA rights that the submitting party does not own or is not authorized to license, or to displace mandatory rights or legal protections that cannot lawfully be waived or licensed.

5.5. No Additional Payment

Unless otherwise agreed in writing or required by applicable law, the licence granted under this section is royalty-free, and AVA is not required to make separate payments to the submitting party for uses falling within the scope of the licence.

The submitting party is responsible for ensuring that any applicable agreements with other rights holders permit the rights granted to AVA and for satisfying any payment or accounting obligations arising from those agreements.

5.6. Duration and Survival

The licence takes effect upon submission and continues perpetually, including after the relevant Awards cycle has concluded, the submitted work is no longer eligible, or the submitting party’s participation in AVA has ended, subject to applicable law and any non-waivable legal rights.

AVA may retain submitted materials in its archives and records for historical, documentation, verification and legitimate organizational purposes, subject to applicable data-protection and other legal requirements.

5.7. Acceptance

Submission of a work constitutes acknowledgment and acceptance of this Submission Licence and Rights Authorization. The submitting party is responsible for ensuring that any artist, creator or other rights holder on whose behalf the submission is made has authorized the submission and the granting of the rights described herein.

6. Acceptable Use

You agree not to:

  • Use the platform for unlawful, fraudulent, deceptive or harmful purposes.

  • Submit content or information that you know to be materially false or misleading.

  • Upload or submit material that infringes another person’s copyright, trademark, privacy, publicity or other rights.

  • Impersonate another person or submit material without the necessary authority.

  • Attempt to gain unauthorized access to accounts, data or restricted areas of the platform.

  • Interfere with the security, integrity or normal operation of the website.

  • Use automated or other means to abuse the platform, manipulate submissions or interfere with voting.

  • Harass, threaten or discriminate against other users through the platform.

7. Moderation, Review and Account Restrictions

AVA may review information, profiles and submissions in order to administer the platform and enforce the applicable requirements.

Where AVA reasonably determines that a profile, submission or account violates these Terms or the applicable Awards Rules and Regulations, AVA may request clarification, restrict access to relevant functionality, reject or remove material, or suspend or terminate an account where appropriate.

Where reasonably practicable, AVA will communicate the reason for a significant restriction or decision. Nothing in this section prevents AVA from taking urgent action where necessary to protect the platform, its users or the integrity of the Awards.

Decisions concerning eligibility, submissions, Academy membership and voting remain subject to the applicable Awards Rules and Regulations.

8. Website Availability and Changes

AVA aims to maintain a reliable platform but does not guarantee uninterrupted or error-free availability. Maintenance, technical problems, security measures or circumstances beyond AVA’s reasonable control may temporarily affect access or functionality.

AVA may modify, improve, suspend or discontinue parts of the website or platform as necessary. Where a change materially affects an active Awards process, AVA will communicate relevant information through appropriate official channels in accordance with the applicable Regulations.

9. Third-Party Services and Links

The website may contain links to third-party websites or use third-party services. These services may operate under their own terms and privacy policies.

AVA is not responsible for the content, availability or practices of third-party websites or services, except where applicable law provides otherwise. A link does not necessarily imply endorsement by AVA.

10. Privacy and Personal Information

AVA handles personal information in accordance with its Privacy Policy and applicable data protection law.

The Privacy Policy explains what information is collected, how it is used, and the circumstances in which it may be shared or retained.

These Terms should be read together with the Privacy Policy.

11. Liability and Applicable Law

To the extent permitted by applicable law, AVA is not responsible for indirect or consequential losses arising from the use of the website or temporary unavailability of the platform.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law. Nothing in these Terms limits any mandatory rights you may have under applicable law.

The applicable law and any procedures for resolving disputes shall be determined in accordance with the relevant legal requirements. These Terms are not intended to override mandatory consumer or other statutory protections.

12. Changes to These Terms

AVA may update these Terms to reflect changes to the platform, its services or applicable legal requirements.

The current version will be published on this page with its effective date. Where a material change affects existing users or an active process, AVA will provide appropriate notice where required by law.

Continued use of the platform after updated Terms take effect constitutes acceptance only to the extent permitted by applicable law. Where renewed consent is legally required, AVA will seek it as appropriate.
